2. Scope of Services

I provide coaching services in the areas of personal development, performance improvement, and goal achievement. Coaching is a non-therapeutic and non-medical process designed to support reflection, awareness, adaptability, and resilience in personal and professional contexts. Coaching does not constitute medical, psychological, psychotherapeutic, legal, financial, or other regulated professional advice.

3. No Medical or Professional Treatment

Coaching is not a substitute for medical treatment, psychotherapy, or professional care. No diagnosis, treatment, or cure is provided or implied.

4. Booking and Access

Coaching sessions are booked online and delivered via third-party communication software. Access to services is granted after successful payment.

5. Pricing and Payment

All prices are stated in Euro (€). VAT treatment is determined in accordance with applicable German law. Payment is required in advance unless otherwise agreed.

6. Rescheduling Policy

Sessions may be rescheduled with at least 24 hours’ notice prior to the scheduled session. Sessions cancelled with less than 24 hours notice or missed without notice are forfeited and non-refundable.

7. Refund Policy

Coaching services are generally non-refundable once a session has been delivered. Unused prepaid sessions may be rescheduled but are not automatically refundable unless explicitly agreed in writing.

8. Right of Withdrawal (EU Consumers Only)

If you are a consumer within the European Union, you may have a statutory right of withdrawal under the Consumer Rights Directive.

Withdrawal Period

14 days from the date of contract conclusion.

Early Expiry of Withdrawal Right

The right of withdrawal expires early if: services have been fully performed, and you have explicitly agreed that performance begins during the withdrawal period, and you acknowledge loss of withdrawal rights once performance is completed

Partial Services

If coaching begins during the withdrawal period, a proportional payment may apply for services already rendered.

9. Third-Party Services

The service relies on third-party providers for communication, payment processing, and digital infrastructure, including but not limited to Zoom Workspace, Stripe, PayPal, Wise, and Proton services.

These providers operate independently. I do not guarantee uninterrupted availability, functionality, or error-free operation of third-party systems.

To the extent permitted by applicable law, I accept no liability for:

  • service interruptions caused by third-party providers

  • payment processing delays or failures

  • communication failures outside of my control

  • data processing or availability issues within third-party systems

In the event that a third-party failure prevents the delivery of a scheduled coaching session, reasonable efforts will be made to reschedule or provide an alternative delivery method.

10. Confidentiality Notice

Information shared during coaching is treated as strictly confidential. Confidentiality may be limited only where required by law or necessary to prevent serious harm.

11. Liability

To the maximum extent permitted by law, no liability is accepted for indirect, incidental, or consequential damages. Nothing excludes liability where such exclusion is not permitted by law.

12. No Guarantee of Results

Coaching outcomes vary depending on individual factors. No specific results are guaranteed. You acknowledge that coaching outcomes depend on your own engagement, commitment, and effort.

13. Intellectual Property

All content, materials, frameworks, exercises, recordings, texts, and coaching resources I provide remain my exclusive intellectual property unless otherwise stated.

Without my prior written consent, no part of the content may be:

  • copied

  • reproduced

  • distributed

  • republished

  • uploaded or shared with third parties

  • modified or adapted

  • used for commercial purposes

You are granted a limited, non-exclusive, non-transferable licence to access and use the materials solely for personal, non-commercial use within the scope of the coaching services.

Any unauthorised use constitutes a breach of these Terms and may result in termination of access and/or legal action where applicable.

14. Data Protection

Data is processed in accordance with applicable laws, including where relevant the General Data Protection Regulation. Full details are provided in the Privacy Policy.

15. Governing Law

These Terms are governed by the laws of Germany. Mandatory consumer protection laws of your country of residence remain unaffected.

16. Coaching Agreement

Coaching services are additionally governed by a separate coaching agreement based on the standards of the International Coaching Federation. In case of conflict, the coaching agreement governs service delivery.

2. Purpose of Data Processing

Personal data is processed for: provision of coaching services, communication with clients, scheduling and administration, payment processing, and legal compliance.

3. Legal Basis for Processing

Where applicable under the General Data Protection Regulation, processing is based on: contract performance, legal obligations, legitimate interests, consent (where required). Outside the EU, processing is based on contractual necessity and legitimate business purposes.

4. Data Storage

Data is stored only for as long as necessary for: service delivery, legal obligations, accounting requirements, and dispute resolution.

5. International Data Transfers

Some of the third-party services I use to deliver coaching may process data outside your country of residence or outside the European Economic Area. Where this occurs, I select providers who apply appropriate safeguards in accordance with applicable data protection law, including standard contractual protections where required under the General Data Protection Regulation. A list of third-party providers is included in Section 6.

6. Third-Party Service Providers and Data Processing

I use carefully selected third-party service providers to operate Solar Flow and deliver services efficiently.

These include:

Communication and Service Delivery

  • Zoom Workspace (video coaching delivery)

  • Telegram (real-time communication)

Payment Processing Services

  • Stripe

  • PayPal

  • Wise (international bank transfer service provider)

Secure Infrastructure and Storage

  • Proton (including Proton Mail, Proton Drive, and Proton Calendar)

6.1 International Data Transfers

Where providers process data outside the European Economic Area, appropriate safeguards are applied in accordance with applicable data protection law.

6.2 Payment Data

I do not store full payment card details.

Payment transactions are processed directly by the respective payment providers (Stripe, PayPal, Wise), which are responsible for the secure handling of payment data.

6.3 No Sale of Personal Data

I do not sell personal data.

I do not share personal data with third parties for marketing purposes.

Data is shared only where necessary to provide services, manage payments, or comply with legal obligations.

7. Confidentiality

All coaching-related communication is treated as confidential.

8. Artificial Intelligence, Recording, and Automated Processing

8.1 Recording Consent

Sessions are not recorded by default.

In the context of group sessions where replay access is part of the offer, participants will be informed of recording in advance. Participation constitutes acknowledgment that the session will be recorded for replay purposes.

Participants who do not consent to being recorded may attend with camera and/or microphone disabled. Their non-consent does not affect the recording of the session or the replay access of other participants.

8.2 Use of AI Tools by the Coach

I may use artificial intelligence tools for administrative and operational purposes only, including session scheduling, internal note organisation, and business administration. AI tools are not used to process, transcribe, or summarise the content of coaching sessions. All session content remains strictly confidential and is handled in accordance with Section 7.

8.3 Third-Party Platform Processing and AI Systems

Coaching sessions may be delivered via third-party platforms, including Zoom Workspace.

These third-party providers may process data independently in accordance with their own terms and privacy policies, which may include automated processing or machine learning-based improvements.

I have no control over, and assume no responsibility for, independent processing activities carried out by such third-party platforms, including any use of data for service improvement, analytics, or artificial intelligence model training.

8.4 Limitation of Responsibility

I am responsible only for the selection and use of reasonable third-party tools for service delivery.

You acknowledge that data processing by third-party platforms occurs outside of my control and is governed solely by the respective providers’ terms.

9. User Rights

Depending on your jurisdiction, you may have the following rights in relation to your personal data:

  • Right of access to your personal data

  • Right to rectification of inaccurate or incomplete data

  • Right to erasure (right to be forgotten), where legally applicable

  • Right to restriction of processing

  • Right to object to processing

  • Right to data portability, where applicable

Where the General Data Protection Regulation applies, these rights will be upheld in accordance with applicable legal requirements.
